The Appeals Court of Kyiv has ruled to remand one of the subjects in the "gas case" Valerii Postnyi in custody with an alternative to post a bail of 250 million hryvnia (approx. $10.01 million).

The court has considered a complaint by the National Anti-Corruption Bureau of Ukraine (NABU) about the previous bail of 1.5 million hryvnia (approx. $60,089), Censor.NET reports citing Hromadske.

As noted, should the bail be posted by Postnyi or a third party, the defendant must stay within the limits of Kyiv and wear an electronic tagging device. As a matter of fact, the prosecution asked to increase the amount of bail up to 1.613 billion hryvnia (approx. $64.616 million). The defense objects to the decision, appealing to the fact that the funds of the suspect and his family have been attached and the bail could not be posted.

"If the sum was 3-5 million hryvnia, it could be acceptable," the lawyer said.

Postnyi, who was taken to court in an ambulance and on a stretcher, said he was ready to cooperate with the investigation.

"I was acquainted with Onyshchenko, and this is my major fault. No one is trying to talk to me. Let me undergo treatment, and then I'll be ready to cooperate with the investigation. I'm not going to flee. I have a seriously ill mother and a brother here. And a minor son. I am a good citizen," Postnyi said.

The prosecution has no doubts about the validity of suspicion. There are reasons to believe Postnyi may evade the investigation and trial in the case of inadequate preventive measures.

Earlier, the court set bails against key subjects in the so-called "gas case" Postnyi and Riaboshapka at 1 million hryvnia and 1.5 million hryvnia respectively. On June 22, after the bails were posted, Riaboshapka and Postnyi were detained again at the exit of the Lukianivske remand prison on new charges in the "gas case." The court set a new bail against Riaboshapka at 100 million hryvnia (approx. $4 million).

Even earlier, the National Anti-Corruption Bureau of Ukraine (NABU) raided the office of MP Oleksandr Onyshchenko March 16. The NABU stated that the searches were carried out under the pretrial investigation of criminal case initiated into abuse of office during sale of the natural gas jointly extracted with Ukrhazvydobuvannia SE.

The NABU requested t he Prosecutor General's Office to lift the immunity of people's deputy Oleksandr Onyshchenko in June.

On June 16, Prosecutor General of Ukraine Yurii Lutsenko drafted a motion requesting the Verkhovna Rada's consent for criminal prosecution, detention, and pretrial confinement of MP Oleksandr Onyshchenko. The Procedural Committee of the parliament allowed considering the withdrawal of parliamentary immunity of MP Onyshchenko on June 29.

On July 5, the parliament approved detention and arrest of people's deputy Onyshchenko.

The SAP submitted Onyshchenko's indictment for Lutsenko's approval July 14. However, the prosecutor general instructed the agency to revise it.
