Slain Maidan activists’ case: court overrules forensic investigator’s challenge requested by Berkut soldiers’ defense

Sviatoshynskyi district court of Kyiv continues hearing the case against five ex-officers of Berkut riot police detachment accused of the murder of 48 Maidan activists on Instytutska Street in Kyiv Feb. 20 2014.

As reported by a correspondent of Censor.NET from the courtroom, the lawyers of the accused Berkut officers filed a motion to challenge forensic doctor Anatolii Kovalenko arguing that his findings could not be considered evidence in the case and insisted on his partiality.

The lawyers of the charged offenders also believe that such anthropometric examination (based on photographs) is illegal since there are no methodologies for holding such examinations in Ukraine.

The prosecution requested the court to deny the challenge. Following a short adjournment, Presiding Judge Serhii Diachuk informed that the court dismissed defense's motion.

As reported, the PGO referred the criminal proceedings against former Berkut riot police officers Zinchenko and Abroskin to court in 2014. They are suspected of shooting 39 Maidan activists on Instytutska street in Kyiv on Feb. 20, 2014. On Feb. 10, 2016, the PGO announced the investigation completed and sent criminal proceeding against three other former Berkut officers, Oleksandr Marinchenko, Serhii Tamtura, and Oleh Yanyshevskyi to court. According to the prosecutor's office, these persons are charged with committing a terrorist act, abuse of official duties, murder, attempted murder, obstruction of peaceful meetings and rallies, as well as abstraction and concealment of weapons after the crime.
