 "Don’t you like it? Well, this is life" - Constitutional Court Head Baulin replied to charges of involvement in usurpation of power by Yanukovych

Chairman of the Constitutional Court Yurii Baulin muted microphone of Samopomich party MP, Head of the Verkhovna Rada Committee for Preventing and Combating Corruption Yehor Soboliev when the latter asked whether the current judges of the Constitutional Court have the right to consider the case on the constitutionality of certain provisions of the Law on the cleansing of power.

During the session of the Constitutional Court on the Law on the cleansing of power, Soboliev repeatedly asked whether it was morally and legally justified (whether it was not a conflict of interests) that seven judges, who had taken decisions that led to the usurpation of power by former President Viktor Yanukovych, considered the case on the constitutionality of provisions of the Law on the cleansing of power if they themselves fell within the purview of this law.

The MP insisted that the court considered the petition for disqualification of these seven judges, including Baulin. The Chairman of the Constitutional Court said that the stage of consideration of motions has been completed. However, in response to the repeated appeals by Soboliev, Baulin nevertheless promised that the petition will be considered after MP's speech in the court.

Also, representative of the Supreme Court of Ukraine Oleksandr Volkov was repeatedly asked during the session of the Constitutional Court how it was possible that the judges of the Supreme Court with low salaries had millions of hryvnias declared in their asset and income disclosures. Soboliev stressed that it was impossible to screen judges without this law. At the same time Baulin repeatedly interrupted Soboliev asking about immense amounts of money declared in asset and income disclosures of the judges. According to the Chairman of the Constitutional Court, it was not the subject of consideration by the Constitutional Court, and it should be dealt with by other agencies. However, Soboliev insisted that it was important since it showed that the abolition of the law will spare judges from purging.

When Soboliev stressed that Baulin was also among those, who decided to abolish the amendments to the Constitution having returned unlimited powers to Yanukovych, and therefore he had no right to make decisions, the Chairman of Constitutional Court said in response: "Don't you like it? Well, this is life."
