Court sanctioned to try Bohatyriova in absentia, - PGO

Prosecutor General's Office launched a special procedure of pre-trial investigation in the case of ex-Minister of Health of Ukraine and other persons suspected of misappropriation of public funds.

Censor.NET reports citing the press service of the Prosecutor General's Office.

The Directorate for investigation of particularly important cases of the Main Investigation Department of the Prosecutor General's Office is investigating the criminal proceedings against former Health Minister Raisa Bohatyriova and other persons on suspicion of misappropriation of budgetary funds in large amounts prosecuted under Part 5 of the Article 191 of the Criminal Code of Ukraine.

The Prosecutor General's Office filed a petition for the initiation of a special pre-trial investigation within the criminal proceedings of May 8, 2015. The Pechersk district court granted permission to carry out the procedure of special pre-trial investigation against former Minister of Health Raisa Bohatyriova on July 23, 2015. The Prosecutor General's Office of Ukraine launched the procedure of special pre-trial investigation of this case in compliance with the Section 24-1 of the Criminal Procedure Code of Ukraine.

The Section 24-1, which the current Criminal Procedure Code of Ukraine has been amended by in accordance with the Law of Ukraine of Oct. 7, 2014, envisages procedure of the special pre-trial investigation (in absentia), i.e. the possibility of conviction by the court in absentia if the person is in interstate or international wanted list. This is the first example of the use of special pre-trial investigation procedure in the history of the Prosecutor General's Office of Ukraine.
