 Rada unable to start session due to discussions on amendments to Constitution, - MP from Poroshenko Bloc

MP from the Petro Poroshenko Bloc faction Mykola Tomenko said that the legal counsels, who developed the draft amendments to the Constitution, have made three grave errors.

In this regard, according to Tomenko's forecast, it is unlikely that there will be 300 votes in the Verkhovna Rada in support of the draft amendments to the Constitution, Censor.NET correspondent reports.

At the same time, Tomenko explained that the Parliament failed to start legislation in the morning due to the fact that less than 226 MPs were ready to support submission of draft amendments to Constitution to the Constitutional Court of Ukraine then.

He noted that discussions primarily concerned amendments to the Constitution regarding granting of special status to the Donbas. "The second problem concerns the institution of prefects of the Russian-French model, as I call it, which has nothing to do with the idea of a parliamentary-presidential republic. There is presidential model of power in Russia while it is presidential-parliamentary one in France. But even in France, for example, the prefects do not issue their own bills and do not interpret the Constitution. At the same time our prefects suspend bills of local government and go to court to figure out whether the Constitution is implemented correctly or not. This is ridiculous. Only the president may seek clarification of the Constitution. And the third position, which is being discussed, is the president's right to suspend the authority of any local government body from village councils to the regional ones during the transition period until October 2017," Tomenko said.

According to him, there could be four reasons for such a decision: "I can even understand if the violation of territorial integrity or national independence is meant, but I do not understand what is meant by the threat to national security. And if the president's legal counsels have not read law on principles of the national security, there is the Article 10 where there are just 71 of threats - from foreign policy threat to the environmental and information one. And imagine if our president dissolves the Village Council and appeals to the Constitutional Court with regard to threat to the national security. I believe that this is unacceptable. The president should be retained the right to suspend the authority of a local government only in case of violation of the territorial integrity or separatism," Tomenko said.

"These are the three issues that are quite alarming" Tomenko summed up.

It should be reminded that the Verkhovna Rada should adopt a resolution to submit the mentioned draft to the Constitutional Court to amend the Constitution and secure 300 votes after receiving the conclusions of the Constitutional Court.
