 Ukraine’s new Supreme Court becomes operational today

The new Supreme Court starts operating in Ukraine on Dec. 15. A the same time Higher Administrative Court, the Higher Economic Court, and the Higher Specialized Court for Civil and Criminal Cases shut down.

The corresponding decision was made at the plenum of the Supreme Court back on Nov. 30, Censor.NET reports.

Once the new Supreme Court commences its work, the old one and the higher special courts cease operating.

The new Supreme Court consists of the Grand Chamber, Administrative Court of Cassation, Economic Court of Cassation, Civil Court of Cassation and Criminal Court of Cassation.

The Supreme Court is the only one reviewing rulings made by the courts of appeals and cassation of the first instance under cassational procedure.

The board of judges of the court of cassation has the right to refer the case to the Grand Chamber of the Supreme Court if it comes to the conclusion that the case contains an exceptional legal issue and such move is necessary to ensure the development of law and the formation of a uniform law enforcement practice.

The Grand Chamber also reviews appeals against rulings made by the Supreme Court as a court of first instance.

The Supreme Court, as the court of first instance, has jurisdiction to consider cases related to results of elections or nationwide referendums obtained by the Central Election Commission; motions regarding early termination of MP’s powers; appeals against bills, actions or inaction of the parliament, president, the Supreme Council of Justice, High Judicial Qualifications Commission.
